These Terms & Conditions (“Terms”) govern your access to and use of BilKit (the “Service”), operated by DevCults Technologies Pvt Ltd(“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. Your account
You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly at connect@thedevscult.com of any unauthorized use. You are responsible for the accuracy of the business, GSTIN, and tax information you enter.
3. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or infringing purpose.
- Issue false or misleading invoices or tax documents.
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service.
- Upload malicious code or infringe the rights of others.
4. Subscriptions & payment
Paid plans, trials, taxes, renewals, and cancellations are governed by our Payment Terms, which form part of these Terms.
5. Your data & ownership
The invoices, clients, and business data you create in the Service belong to you. You grant us a limited license to host and process this data solely to provide the Service. We handle your personal data as described in our Privacy Policy.
6. Intellectual property
The Service, including its software, design, and branding, is owned by DevCults Technologies Pvt Ltd and protected by applicable law. These Terms do not grant you any right in our intellectual property except the limited right to use the Service.
7. Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features from time to time.
8. Disclaimers
The Service is provided “as is” and “as available”. BilKit is a tool to help you prepare invoices and tax documents; it does not constitute legal, tax, or accounting advice. You are responsible for the correctness of your filings and for consulting a qualified professional where needed.
9. Limitation of liability
To the maximum extent permitted by law, DevCults Technologies Pvt Ltd shall not be liable for any indirect, incidental, or consequential damages, or for loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service shall not exceed the amounts you paid to us in the twelve months preceding the claim.
10. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that may cause harm or legal liability. On termination, your right to use the Service ends; provisions that by their nature should survive will survive.
11. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to any applicable law, the courts at our registered place of business in India shall have exclusive jurisdiction over any disputes.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by notifying you within the Service. Continued use after changes take effect constitutes acceptance.
